The Embassy of Ukraine in Poland clarified that the announcement by the Polish authorities regarding the extension of the validity of temporary protection certificates did not apply to Ukrainian citizens who have temporary protection in the country under the special law. This information was posted on the Facebook page of the Embassy of Ukraine in Poland.
The Embassy clarified that the announcement from the Foreigners Affairs Office, which was largely understood as an extension of the temporary status for Ukrainians, did not apply to individuals with a PESEL and UKR status. It does not imply an extension of temporary protection for Ukrainian citizens who obtained this status based on the special law of March 12, 2022.
In a comment to "Radio Svoboda," the embassy further explained that this decision applies to stateless individuals or citizens of third countries – other than Ukraine – who can prove that they legally resided in Ukraine until February 24, 2022, based on a valid permanent residency permit issued in accordance with Ukrainian law. These individuals must also demonstrate that they cannot safely return to their country or region of origin.
Also, this document extends protection until 2025 to stateless persons or citizens of third countries other than Ukraine (and their family members), who had international protection or equivalent national protection in Ukraine as of February 24, 2022.
As reported by the Polish publication Dziennik Gazeta Prawna, the decision to extend temporary protection specifically for Ukrainians is still in progress. The document will be submitted for approval to the Sejm in the coming weeks.
The uncertainty regarding the continued stay of Ukrainians with temporary protection in Poland is a source of concern not only for the individuals themselves but also for the employers who have them in their employment.
